UC San Diego Research Affairs –The Office of Innovation and Commercialization is partnering with Foley and Lardner LLP, a premier law firm in corporate and intellectual property matters, to bring Trending Topics in Healthcare IP Seminar series to UC San Diego and the Mesa.
Some of the most valuable assets of life science and medical device companies are in the form of the personal information (PI) that have been collected or processed, and the intellectual property derived from this data. Examples of personal information collected in life sciences include financial information (e.g., personal accounts, social security information, identifiers), personal health information (e.g., medical history, demographic info, test and lab results, insurance information, etc.), and raw or aggregated medical data (e.g., information from heart, glucose and blood monitors, information posted or made available on social platform like WebMD, or other data collected from wearable devices, like the FitBit). These assets have value to both the patients and the companies. The incredible value of digital life sciences and medical device PI and IP makes them ripe targets for cyber thieves and hackers. The real costs of a data breach, including the direct and indirect costs related to lost profits or customers, can be devastating to companies in any arena; but the healthcare and life science/medical device industries are especially impacted, with the highest costs per capita in the event of a data breach – $402 and $301, respectively, compared to the overall mean of $221. This presentation will review case histories of data security breaches and offer proactive approaches to protect this information, for example administrative policies and procedures, physical safeguards (e.g., secure facilities and paper files) and technical safeguards (encryption, firewalls, etc.). In addition, tips for handling a security breach will be reviewed, with the goal to forgo immediate and long term injury to a company’s reputation and the patient’s information.
